| Note: Held By: DBEVAN Released By: DBEVAN The submitted U.S. Army Corps of Engineers (USACE) Nationwide Permit expired on March 18, 2007, and would typically require a modification to the permit prior to the City permitting the proposed construction; however, it appears that the structure already exists. Denise Bevan, Environmental Planner, performed a site visit on June 5, 2007, and observed the proposed boat dock structure already constructed. Due to the "after-the-fact" circumstances, please provide copies of completed USACE "certification statement of compliance" and Department of Environmental Protection (DEP) "as bulit certification" forms provided in the permit package to verify compliance and coordination with the regulatory agencies. Please be aware that gopher tortoise burrows were observed within the vicinity of the subject property. All activities must retain a 25-foot setback from a gopher tortoise burrow entrance per State authority, Florida Fish and Wildlife Conservation Commission (FWC). If the setback cannot be retained, coordination and permitting with the FWC is required, and thus, the City would require the associated permits. | |||
