Note: The waters within the saltwater canals of Palm Coast are State waters and fall within their jurisdiction. The Citizens of Palm Coast own the saltwater canal bottoms in Palm Coast, which are administrated and licensed by the City of Palm Coast. There are no riparian rights that run with the land for lots adjacent to any waterway within the City of Palm Coast. Those that wish to have a dock on any waterway must seek a license from the City of Palm Coast in order to use community property for personal use within the canals. The City controls the size of structures within the licensable building envelope allowed by the technical manual. The building envelope is determined by projecting the property lines out the appropriate distance along the same path the property lines follow. The only exception is when those property lines meet, or are adjacent to, a corner of a canal. At that point the area is divided at a 45 degree angle to provide equal access for both landowners. Given the area available the dock structure as shown is permissible. An allowance can be made for a reduced set back and a slight extension beyond the allowed extension in the water. However the allowable foot print is not large enough to allow for a lift or any other structure and will not be permitted. Though the City regulates the size and type of structures within the licensable footprint, the City does not regulate the size of vessels moored to docks, as they are considered temporary. However, if the size of the vessel impairs or impedes the navigational areas of the waterways that is a matter that falls within the jurisdiction of the U.S. Coast Guard, the State of Florida and the Flagler County Sheriff’s office.
