This driveway as it currently sits is considered to be a Legal Non-Conforming structure - meaning it does not meet our current Land Development Code requirements so if it is to be removed and replaced it will need to be constructed to current LDC standards. There is a 5' platted utility easement around the inside perimeter of the property lines and the new driveway must maintain a 5' side setback as driveways cannot encroach in the side easement. Also, there are size minimum and maximum dimensional requirements for driveways.
