| Note: Held By: TRACEY DOAK - (386)986-3751 - TDOAK@PALMCOASTGOV.COM There is a platted 5' utility easement on the perimeter of the lots. If you cannot keep the generator out of the easement, you can submit a 2' Easement Encroachment License Agreement for Mechical Equipment or Walkways. This means that you would only be allowed to encroach a maximum of 2' into the platted utility easement. Even though the owner bound his lot to lot 9, there is still the easement on both sides of the lot line. So you can either move the generator so that it does not encroach in the easement of complete the Agreement. The Agreement would need to be signed by all persons on the deed to the property and all owner's names would need to be notarized. Once this is complete, an electronic copy will need to be submitted to the permit for staff review and once it is checked for correctness, we will require the original for recording. Please note that you will also need to clearly show how much the generator is encroaching by providing the setback to the property line between lots 9 & 10 as the easement still exist on either side of the lot line.
